Terms of Service

The fine print, in plain English.

What you agree to by becoming a member of New York Studio Factory and using our studios.

Last updated May 9, 2026

1. Membership Review

NYSF offers two membership types: Flex (pay-as-you-go bookings, no monthly commitment) and Private (monthly studio lease, 24/7 access). Both require an account in good standing.

You may cancel a Flex account at any time with no penalty. Private memberships follow the lease terms in your signed agreement; this site does not modify those terms.

2. House rules Review

While on premises, you agree to:

This section is awaiting founder review.

3. Liability Review

Use of NYSF studios is at your own risk and the risk of your clients. NYSF maintains general liability insurance for the building; you are responsible for your own professional liability insurance covering services rendered to your clients.

Specific liability caps and indemnification language to be inserted by counsel.

4. Content & media Review

Content you create on premises (photo, video, audio) is yours. NYSF may request to feature member work in marketing — we'll always ask first and credit you.

DMCA, talent releases, and likeness rights for shared spaces being finalized.

5. Payment

All bookings are charged in full at the time of booking via Square. NYSF does not store card data; refer to Square's terms for payment processing details. Refund logic is governed by our Booking Policy.

6. Account & access

Authentication is by magic link to the email address on file. Door codes are issued per booking and active 30 minutes before through the end of your reservation. Sharing magic links or door codes with non-booked parties is grounds for account suspension.

7. Termination

NYSF may suspend or terminate accounts for repeated no-shows, damage, harassment of staff or other members, or material breach of these terms. We will refund any unused pack hours pro-rata if NYSF terminates an account for non-conduct reasons.

8. Governing law Review

These terms are governed by the laws of the State of New York. Disputes will be heard in Kings County, NY. Counsel to confirm.

9. Changes

We may update these terms; if we do, we'll email active members and post the change date here. Continued use after a change means you accept the new terms.
